3. Client Obligations

As a client, you agree to:

Provide accurate and complete information about your business and marketing goals
Grant necessary access to marketing platforms and analytics tools
Review and approve strategies and content in a timely manner
Pay all fees as agreed upon in your service agreement
Comply with all applicable laws and regulations regarding marketing practices
Not use our services for any illegal, harmful, or fraudulent purposes

4. Free AI Marketing Audit

Our free AI marketing audit is provided as a complimentary service to evaluate your current marketing performance. This audit:

Is provided at no cost and with no obligation to purchase services
Includes an analysis of your current marketing activities
Provides recommendations for improvement using AI-powered strategies
May be used by Wittwise to demonstrate service capabilities

5. Intellectual Property

All content, features, and functionality of our website and services, including but not limited to text, graphics, logos, and software, are owned by Wittwise and are protected by international copyright, trademark, and other intellectual property laws.

Upon full payment for services, clients receive a license to use deliverables created specifically for them. Our proprietary AI tools, methodologies, and processes remain the exclusive property of Wittwise.

6. Confidentiality

We understand the sensitive nature of business information. Both parties agree to:

Keep confidential all proprietary information shared during the engagement
Use confidential information only for the purposes of providing or receiving services
Not disclose confidential information to third parties without written consent
Return or destroy confidential information upon termination of services

7. Results and Guarantees

While we strive to deliver exceptional results and use data-driven AI strategies to optimize your marketing, we cannot guarantee specific outcomes. Marketing results depend on many factors including market conditions, competition, and your business operations.

Case studies and testimonials represent individual client results and are not guarantees of future performance.

8. Payment Terms

Payment terms will be specified in individual service agreements. General terms include:

Invoices are due within 14 days of issuance unless otherwise agreed
Late payments may incur additional fees
Services may be suspended for overdue accounts
All fees are non-refundable unless otherwise specified

9. Limitation of Liability

To the maximum extent permitted by law, Wittwise shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability for any claims under these terms shall not exceed the amount paid by you to Wittwise in the twelve months preceding the claim.

10. Termination

Either party may terminate services with 30 days written notice, unless otherwise specified in the service agreement. Upon termination:

All outstanding fees become immediately due
Access to our tools and platforms will be revoked
We will provide transition support as reasonably necessary
Confidentiality obligations continue to apply

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify clients of material changes via email or through our website. Continued use of our services after changes constitutes acceptance of the modified terms.
